At TIMO, our primary mission is to enhance lives through education. We empower individuals worldwide to enroll in our educational courses and acquire knowledge. We believe our approach offers the most effective means of providing valuable educational content to our users. To ensure the safety of our platform and services for all stakeholders, including you, us, and our instructors, we have established the following terms and conditions, which apply to all your interactions with the TIMO website, our APIs, and related services collectively referred to as "Services."

1. Account Management

Creating an account is a prerequisite for most activities on our platform, such as purchasing courses or applying to become an affiliate. It's your responsibility to furnish accurate and complete information, including a valid email address when setting up and maintaining your account. You are entirely accountable for your account, including any activities that occur on it. This includes any harm or damage caused by unauthorized use of your account. It is crucial to safeguard your password, and you may not share your account or use someone else's account without their consent. If you need access to an account, you must provide the necessary login credentials. In the unfortunate event of a user's passing, their account will be closed.

If you share your account login information with another party, you bear responsibility for any actions taken on your account. TIMO will not mediate disputes arising shared account login credentials. Promptly report any unauthorized account use or security breaches by contacting our Support Center. We may request additional information to confirm your account ownership.

Users must be at least 18 years old to create an account on TIMO and utilize the Services. If you are under the required age, we encourage you to have a parent or guardian create an account to assist you in enrolling in age-appropriate courses. Accounts created by individuals under the age of consent will be terminated. You may terminate your account at any time by contacting our Support Center. Consult our Privacy Policy for information regarding the consequences of account termination.

2. Course Enrollment and Access

When instructors publish courses on TIMO, they grant us a license to provide these courses to our users. By enrolling in a course, you obtain a license to access and view it through the TIMO platform and Services. Courses are licensed, not sold, and you do not have the right to resell or share course content without explicit permission. You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial, educational purposes, subject to these Terms and any course-specific conditions or restrictions. All other uses are prohibited, such as reproduction, redistribution, transmission, sale, modification, adaptation, creation of derivative works, sublicensing, or any other form of unauthorized use, unless authorized in writing by a TIMO representative. This policy extends to content accessible via our APIs.

While we typically grant lifetime access to courses, we retain the right to revoke access at any time, especially if required by legal or policy reasons. For instance, if a course faces copyright complaints or violates our Trust & Safety Guidelines, access may be restricted. Note that this policy does not apply to add-on features and services associated with a course, which may be disabled or modified by instructors.

3. Payments and Refunds

3.1 Pricing

Course prices on TIMO are determined based on our Instructor Agreement and Pricing and Promotions Policy. We occasionally offer promotions and sales with courses available at discounted rates for a limited time. The course price at the time of purchase will be applicable at checkout. Prices may vary for registered and non-registered users, as certain promotions are exclusive to new users. Users in countries where applicable taxes apply to consumer sales will see prices inclusive of such taxes.

3.2 Payments

By purchasing courses, you agree to pay the associated fees and authorize us to charge your account balance. TIMO collaborates with third-party payment processing partners to offer convenient payment methods while maintaining payment security. Invalid or unauthorized payment methods are prohibited. We reserve the right to disable access to any course due to fraudulent payments. Confirmed purchases are non-refundable, and no credit or refund will be provided. Please review your choices carefully before completing a payment transaction.

4. Content Guidelines

If we receive notices of course or content violations, be it related to legal issues or infringements on the rights of others, we may remove such content our platform. TIMO adheres to copyright laws and has the discretion to enforce these Terms and our Trust and Safety Guidelines. We may terminate or suspend your platform access, services permission, or account without notice, for violations of these Terms, upon request of law enforcement or government agencies, due to prolonged inactivity, unexpected technical issues, or suspicions of fraudulent or illegal activities. We assume no liability for such actions and their consequences.

If you believe a course infringes on your copyright or trademark rights, please inform us. Our Instructor Agreement mandates instructors to comply with the law and respect intellectual property rights. 5. Utilizing TIMO for Learning

Our central mission is to enhance lives through learning. By purchasing courses on our platform, you acknowledge that your primary goal is to gain new knowledge and skills. Misuse of our learning platform, such as enrolling in courses solely to become an affiliate, may lead to the suspension or termination of your account and access to our services.

6. Using TIMO at Your Own Risk

TIMO provides access to various courses for learning purposes. Similar to other platforms with substantial content offerings, there may be occasional issues. You use TIMO at your own risk. We host numerous courses and do not exert editorial control over their content. We do not guarantee the reliability, validity, accuracy, or truthfulness of courses. By enrolling in a course, you assume these risks. You may encounter content you find offensive, indecent, or objectionable, and we hold no responsibility or liability for your access to such content, by applicable law. This includes courses related to health, wellness, and physical exercise, where you voluntarily accept the associated risks, such as illness, injury, disability, or death.

We do not employ instructors and are not liable for disputes, claims, losses, injuries, or damages related to interactions between instructors and users. We are also not responsible for third-party websites linked to our Services, including their data collection practices. Review their terms and conditions and privacy policies.

7. TIMO's Rights

All rights to the TIMO platform, Services, applications, APIs, s, and content submitted by our employees or partners (excluding instructor-provided content) belong exclusively to TIMO and its licensors. Our platforms and services are protected by copyright, trademark, and other laws. You may not use the TIMO name, trademarks, logos, domain names, or other brand features. Feedback or suggestions provided about TIMO or the Services are voluntary, and we may use them at our discretion without obligation.

When using the TIMO platform and Services, you are prohibited :

Accessing or tampering with non-public areas.
Disabling or circumventing security features.
Copying, modifying, or reverse-engineering source code.
Using automated means to access the Services.
Sending false source-identifying information.
Interfering with user, host, or network access.
8. Miscellaneous Legal Terms

8.1 Binding Agreement

By registering, accessing, or using our Services, you are entering a legally binding contract with TIMO. If you do not agree with these Terms, refrain using our Services. If you are accepting these Terms on behalf of an entity, you warrant your authority to do so.

8.2 Disclaimers

Our Services are provided "as is" and "as available." We disclaim any warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no guarantees about the reliability, accuracy, or availability of our Services. TIMO reserves the right to discontinue features without liability for any resulting disruptions.

8.3 Limitation of Liability

To the extent permitted by law, we and our affiliates, suppliers, partners, and agents will not be liable for indirect, incidental, punitive, or consequential damages. 

8.4 Indemnification

If your actions lead to legal issues, you must indemnify and hold TIMO and its entities harmless against third-party claims, demands, losses, and expenses arising your content, use of our Services, or violations of these Terms.

8.5 Governing Law and Jurisdiction

These Terms are governed by United States law, and you consent to the exclusive jurisdiction and venue of the State Courts of the United States. Dispute Resolution may apply under certain conditions.

8.6 Legal Actions and Notices

Claims arising these Terms must be brought within one year. Notices will be in writing, sent by registered or certified mail with the return receipt requested, or emailed to support@thetimo.ai

8.7 Relationship Between Us

No agency, partnership, employment, or contractor relationship exists between us.

8.8 No Assignment

You cannot transfer these Terms or your account rights. We may assign these Terms without restriction. Third parties have no rights under these Terms.

9. Updating These Terms

We may update these Terms to reflect changes or new practices. Material changes will be communicated through prominent means. Continued use of our Services implies acceptance of the changes.
